This Product Technical & Safety Disclaimer (“Disclaimer”) applies to all hydraulic equipment, torque tools, lifting systems, pullers, induction equipment, pressure pumps & related products manufactured & supplied by ITORQ & ITORESQ (“Product”).
This Disclaimer governs allocation of technical responsibility, safety obligations & liability in connection with the Product.
Advisory Nature of Technical Information
All technical specifications, load ratings, pressure ratings, torque values, drawings, illustrations, performance data & recommendations provided by ITORQ & ITORESQ are furnished in good faith for general guidance only.
Such information:
- Does not constitute certified engineering design;
- Does not replace independent structural verification;
- Does not constitute project-specific approval;
- Shall not be treated as system-level certification.
Final verification of suitability for intended application rests solely with the Customer.
Engineering & Application Responsibility
The Customer bears sole responsibility for:
- Verifying load requirements;
- Determining appropriate safety factors;
- Calculating structural capacity of supporting members;
- Verifying anchoring points;
- Ensuring counterforce resistance;
- Assessing load distribution;
- Determining dynamic or shock-loading impact;
- System integration decisions;
- Ensuring compliance with local codes & statutory regulations.
ITORQ & ITORESQ shall not be responsible for engineering decisions made by the Customer, consultants, site engineers, or contractors.
Rated Limits & Operating Boundaries
Maximum operating pressure is marked or stamped on the Product.
Maximum load capacity & design performance limits are specified in:
- Quotations,
- Technical data sheets,
- Product documentation,
- Written communication.
Operation beyond any rated specification, including but not limited to:
- Over-pressurization,
- Overloading,
- Eccentric loading,
- Side loading,
- Shock loading beyond design intent,
shall immediately void warranty & release ITORQ & ITORESQ from liability.
Proper Installation Responsibility
The Customer is solely responsible for ensuring:
- Correct installation procedures;
- Proper alignment;
- Stable mounting;
- Adequate foundation support;
- Compatible hydraulic & electrical interfaces;
- Absence of fluid contamination;
- Correct hose & fitting connections.
Improper installation voids warranty & releases ITORQ & ITORESQ from resulting claims.
Operator Qualification
Products must be operated only by trained, qualified & competent personnel familiar with:
- Hydraulic systems,
- Torque application protocols,
- Industrial lifting procedures,
- Pressure system handling,
- Emergency shut-down procedures.
ITORQ & ITORESQ does not verify operator competence & assumes no responsibility for operator error.
Maintenance & Inspection Obligations
The Customer is responsible for:
- Routine inspection prior to each use;
- Periodic maintenance;
- Replacement of wear components;
- Monitoring for leaks or structural damage;
- Ensuring calibration where required;
- Maintaining inspection logs where applicable.
Failure to maintain proper inspection & maintenance voids all warranty & liability.
Calibration Requirements
Products requiring calibration, including torque tools & precision equipment, must be calibrated periodically in accordance with recognized industrial standards.
ITORQ & ITORESQ shall not be responsible for performance deviation arising from:
- Lack of recalibration;
- Improper calibration;
- Unauthorized calibration.
Environmental Conditions
ITORQ & ITORESQ is not responsible for damage or performance degradation caused by:
- Corrosive environments;
- Chemical exposure;
- Temperature extremes;
- Improper storage;
- Excessive humidity;
- Contamination.
Customer must independently verify environmental suitability.
Integration with Third-Party Equipment
ITORQ & ITORESQ assumes no responsibility for:
- Failures caused by third-party power units;
- Integration into non-approved systems;
- Modifications performed by customer;
- Interfacing with incompatible accessories.
Compatibility assessment is solely the responsibility of the Customer.
Prohibited Modifications
The following actions are strictly prohibited & void all warranty & liability:
- Welding or structural alteration;
- Machining or drilling modification;
- Removal or alteration of safety features;
- Tampering with serial numbers;
- Reverse engineering;
- Retrofitting without written approval.
Injury & Damage Disclaimer
To the maximum extent permitted by law, ITORQ & ITORESQ shall not be liable for:
- Personal injury;
- Fatal injury;
- Property damage;
- Equipment damage;
- Loss of revenue;
- Production downtime;
- Indirect, incidental, special, or consequential damages;
arising from:
- Misuse,
- Improper operation,
- Failure to follow manuals,
- Structural inadequacy of site conditions,
- Improper load calculation,
- Overloading.
No Site Supervision
In product supply transactions, ITORQ & ITORESQ does not supervise field operations & does not assume responsibility for:
- Site safety execution;
- Compliance with site permit systems;
- Structural adequacy of lifting or anchoring points;
- Implementation of barricading or hazard control;
- Enforcement of safety practices.
Site safety compliance remains solely the responsibility of the Customer.
Technical Advice Disclaimer
Any technical advice provided verbally or in writing:
- Is advisory only;
- Does not modify warranty terms;
- Does not create new obligations;
- Does not constitute engineering certification.
Limitation of Liability
ITORQ & ITORESQ’s total cumulative liability arising from any claim related to the Product shall not exceed the invoice value of the specific Product supplied.
Under no circumstances shall ITORQ & ITORESQ be liable for:
- Loss of profit;
- Loss of production;
- Contract penalties;
- Delay claims;
- Consequential damages;
- Third-party claims.
This limitation applies regardless of cause of action.
Relationship to Other Documents
This Disclaimer shall operate together with:
- Terms & Conditions of Sale;
- Global Guarantee.
In the event of inconsistency, the limitation of liability provisions shall prevail.
Governing Law & Jurisdiction
This Disclaimer shall be governed exclusively by the laws of India.
All disputes shall be subject to exclusive jurisdiction of the courts located in Hyderabad, Telangana.
Acceptance
Use, installation, or retention of the Product constitutes acceptance of this Product Technical & Safety Disclaimer.
